1. About these terms
These terms cover this website and MoveableIQ's text message program for families, which is described in section 6. By using this site, you agree to them.
A school district's use of the MoveableIQ application is governed by a separate agreement with that district. Nothing here replaces or overrides it.
2. What is informational, and what is binding
The descriptive content on this site, what the product does, who it is for, and what it can do for a district, is provided for general information. It is not a contract, an offer, or a binding commitment, and it may change as the product changes.
The text message terms in section 6 are not descriptive content. They set out how the messaging program actually operates: who receives messages, how a family agrees to receive them, and how a family stops them. They apply to that program and are not covered by the paragraph above.
3. Acceptable use
You agree not to misuse the site, for example, by attempting to disrupt it, accessing it through automated means at a scale that degrades service, or using it for any unlawful purpose.
4. Intellectual property
The MoveableIQ name, logo, site content, and design are the property of their respective owners and may not be copied or reused without permission.
5. External links and services
The site may link to third-party resources and loads some assets from a third-party content delivery network. We are not responsible for the content or practices of third parties.
6. Text messages to families
Districts using MoveableIQ can send text messages to a parent or guardian about their own student’s attendance: absences, attendance concerns, and what the family can do next. A staff member decides to send each one, to one family, about one student. There are no marketing texts and nothing sends on a schedule.
A family must agree before any text is sent to them, and agreeing is optional. Consent is requested through a link emailed to the address the district holds for that family, and it applies to the specific mobile number on file. If that number later changes, consent does not carry over and the family is asked again. A family who does not agree, or who never answers, is not texted; their student’s enrollment, attendance record, and access to school services do not depend on the answer.
Reply STOP to any message to stop receiving texts from that district, or HELP for help. Opt-outs are honored automatically by the messaging service that carries them, and MoveableIQ also marks a number that has opted out so that staff are no longer offered texting as a way to reach that family. Message frequency varies. Message and data rates may apply through the family’s own mobile carrier; MoveableIQ makes no charge for the service.
A mobile number and a family’s answer are not shared for marketing. Neither is shared with third parties or affiliates for marketing or promotional purposes, and neither is sold or rented. A number is used only to send the district’s own attendance messages to the family it belongs to, and is passed only to the carrier that delivers them.
An opt-out is carried out by the messaging service itself, not by MoveableIQ, so it cannot be reversed here. A family who later wants texts again has to text START from the same number. Neither the district nor MoveableIQ can turn them back on on the family’s behalf.

7. No warranty
The site is provided “as is” without warranties of any kind, express or implied. We do not guarantee that it will be available, accurate, or error-free at all times.
8. Limitation of liability
To the extent permitted by law, we are not liable for any loss or damage arising from use of, or inability to use, this website.
9. Governing law
These terms are governed by the laws of the state in which MoveableIQ is organized, without regard to conflict-of-laws principles.
10. Changes
We may update these terms as the site evolves. The “last updated” date above reflects the most recent change.
